1. Nature, scope and limits of the service
1.1. Consulting and Support Service (Obligation of Means)
The service provided by THE COMPANY consists of technical tax consulting, guidance, preliminary analysis, preparation of drafts, simulations, direction, educational support and accompaniment so that THE CLIENT can properly meet their tax obligations in Colombia.
The service is an obligation of means, not of result.
THE COMPANY provides guidance but does not guarantee specific results, DIAN interpretations, the absence of requests from the DIAN, or the reduction of penalties.
1.2. Professional Competence without Certifying Responsibility
THE COMPANY's team is made up of lawyers and certified public accountants with expertise in tax matters.
However, the subscription and the services derived from it do NOT imply:
- accounting certification,
- an accountant's signature,
- an audit opinion,
- statutory audit (revisoría fiscal),
- legal representation before the DIAN,
- formal preparation of tax returns,
- a mandate,
- responsibility as preparer or certifier.
1.3. Exclusive Operational Responsibility of the Client
All formal actions before the DIAN, financial institutions and invoicing platforms are carried out exclusively by THE CLIENT, including:
- logging in with their own credentials,
- entering data,
- electronic signature,
- filing tax returns,
- submitting documents,
- issuing invoices,
- payments and official procedures.
THE COMPANY only accompanies, guides and advises, and does not replace these operational functions.
1.4. Client's Electronic Signature and Passwords
We do not request or use your electronic signature or your DIAN or other platform passwords. If you need help with a procedure, we guide you in a shared session and you log in, approve, sign and file.
2. Subscription, payments and cancellation
2.1. Invoicing and Currency
Payments may be processed by THE COMPANY's legal entity in Germany or by its subsidiaries. Invoices will be issued in USD, EUR or COP depending on the platform.
2.2. No Minimum Term
The subscription has no minimum term.
Cancellation must be requested before the end of the current period.
2.3. Payments, Right of Withdrawal and Refunds
Payments are made in advance. If you purchase remotely or electronically, you may exercise the right of withdrawal (derecho de retracto) within five (5) business days after purchase (Law 1480 of 2011, art. 47) by writing to admin@taxcontractorslatam.com, provided we have not started providing the service. If you ask us to start the service within that period and expressly accept it, the right of withdrawal is limited to the extent the service has already been provided. Outside those cases, payments are non-refundable, without prejudice to the consumer's non-waivable rights and legal guarantees, and except where we fail to provide the contracted service for reasons attributable to us, in which case we refund what you paid.
Income Tax Plan booking (USD 50). The USD 50 booking secures your spot and our initial review work. It is non-refundable if you cancel after agreeing that we start the review, without prejudice to the right of withdrawal and your consumer rights. If we cannot provide the service, we refund the booking.
2.4. Late Payment and Suspension
In the event of late payment, THE COMPANY will notify you by email or WhatsApp and, if payment is not made within five (5) days after the notice, may suspend or cancel the service. Any tax consequences arising from this will be the sole responsibility of the Client.
2.5. Income Tax Plan: Level and Price Adjustment
The price is calculated based on the income you declare. If, when reviewing your documents, it turns out to be different, we adjust the price to the corresponding level. The client may accept the adjustment or cancel before filing. If the client cancels, the USD 50 booking is governed by clause 2.3.
2.6. Subscription Cancellation
You can cancel your subscription at any time through the same channel you used to purchase it or by writing to admin@taxcontractorslatam.com. Cancellation takes effect at the end of the period already paid: no new charges are made and you keep the service until that date.
